New Participant Form and Indemnity Waiver

Acknowledgments, Release and Indemnity - please read

ACKNOWLEDGEMENTS:

I acknowledge that:

1. Participating in yoga exercises, with or without the use of equipment, carries possible safety and health risks, including the risk of soreness, injury or serious injury.
2. With full knowledge of the risks, I voluntarily accept these risks when participating in any class provided by Miami Yoga Room.
3. I have been advised to seek advice from a medical practitioner before commencing any new physical activity. I understand that the teachers and instructors of Miami Yoga Room do not and cannot provide any medical advice. Should I experience pain or soreness during my class, I will immediately stop the activity.
4. I understand that it is my responsibility to assess my physical and mental capabilities and to choose the appropriate level of class for my skills, abilities and any limitations, and so as not to aggravate any existing injuries. I have advised Miami Yoga Room teachers or instructors of any relevant physical or mental conditions or limitations I may have. I understand that Miami Yoga Room teachers or instructors may suggest yoga exercises or stretches, and it is ultimately my responsibility to determine if the yoga exercise or stretch is appropriate for me, and whether to follow the guidance provided by the yoga instructor or teacher. I agree not to exceed my limits and to only perform those yoga exercises and stretches that I am physically capable of performing.
5. Miami Yoga Room reserves the right for its teachers, instructors, directors or staff to refuse entry or participation to any participant who is under the influence of alcohol or any substances that may affect their ability or behaviour towards the teacher, instructor or other participants.

INDEMNITY AND WAIVER

In consideration for being permitted to participate in the yoga class, I acknowledge that neither Miami Yoga Room, its teachers, instructors, directors or employees shall be responsible or liable in any way whatsoever for any injury, illness, soreness, loss or damage I may sustain arising directly or indirectly from my participation in a class provided by Miami Yoga Room, or for any loss or damage to property. I expressly waive and release Miami Yoga Room, its teachers, instructors, directors and employees, to the fullest extent permitted by law, from any claim I, my heirs, assignees and successors may have for any soreness, injury, illness, damage or loss of any kind sustained by me, arising directly or indirectly from my participation in a class provided by Miami Yoga Room.  I, my heirs, assignees and successors, indemnify Miami Yoga Room, its teachers, instructors, directors and employees, from and against any and all claims, actions, costs and expenses whatsoever which may be taken or made against Miami Yoga Room, its teachers, instructors, directors or employees in connection with or arising from or out of any soreness, injury, illness to me or any loss or damage to property associated with my participating in the yoga class.
